Overview

These Terms of Service ("Terms") govern your use of the HMBInk online store at hmb.ink (the "Store"), operated by Aleksei Avduevskii, trading as HMBInk, a sole trader registered in England and Wales ("we", "us", "our").

Our Store is powered by Shopify, Inc., which provides the underlying e-commerce platform. Any purchases you make are made directly with Aleksei Avduevskii trading as HMBInk, and Shopify bears no responsibility for transactions, products, or disputes arising from your use of the Store.

By placing an order or using the Store, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy (available at hmb.ink/policies/privacy-policy). If you do not agree, please do not use the Store.

At checkout, you will be asked to tick a box confirming your acceptance of these Terms before completing a purchase. This constitutes your explicit agreement.

Section 2 — Access and Eligibility

By using the Store, you confirm that you are at least 18 years old, or that you have the consent of a parent or guardian. You are responsible for ensuring that any information you provide — including name, billing address, payment details, and email — is accurate, current, and complete.

You are solely responsible for maintaining the security of any account credentials. You may not transfer your account to any other person.

Section 3 — Our Products

HMBInk sells printed clothing, primarily cotton t-shirts featuring original artwork. All products are physical goods available for one-time purchase — no subscriptions or recurring billing apply.

We make every effort to display products accurately. However, colours may appear differently on screen depending on your device settings. We do not guarantee that product appearance will match your expectations precisely.

Product descriptions, prices, and availability are subject to change at any time without notice. We reserve the right to limit quantities or discontinue any product.

Section 4 — Orders and Contract Formation

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm it by email. We reserve the right to decline or cancel any order at our discretion.

We must receive and process your payment before an order is accepted. Once accepted, our ability to accommodate cancellations is limited — please review your order carefully before submitting.

If we decline, modify, or cancel your order, we will contact you using the details provided at checkout.

Section 5 — Prices and Payment

All prices are displayed in GBP and include applicable VAT where required. Prices do not include shipping, which is calculated at checkout.

Prices may change without notice. The price charged will be the price shown at the time your order is placed, as confirmed in your order confirmation email.

By providing payment details, you confirm that you are authorised to use that payment method and that charges will be honoured.

Section 6 — Shipping and Delivery

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or circumstances outside our control.

Risk of loss and title pass to you once we hand the product to the carrier.

Section 7 — Returns and Refunds

We have a 30-day return policy. To be eligible, items must be returned within 30 days of receipt, in their original condition — unworn, unused, with tags attached, and in original packaging.

How to start a return: Contact us at avduevskij@gmail.com with your order details. Do not send items back without contacting us first — unrequested returns will not be accepted.

Once your return is received and inspected, we will notify you whether your refund has been approved. Approved refunds will be issued to your original payment method within 10 business days.

Non-returnable items

The following cannot be returned:

• Sale items and gift cards

• Custom or personalised products

• Items not in their original condition

Damaged or incorrect items

Please inspect your order upon receipt. If your item is defective, damaged, or incorrect, contact us immediately at avduevskij@gmail.com so we can resolve the issue.

Exchanges

To exchange an item, return it under the process above and place a new order once your return is accepted.

EU customers — 14-day cooling-off period

If your order is shipped to the European Union, you have the right to cancel or return your order within 14 days of receipt, for any reason and without justification, under the EU Consumer Rights Directive. The same condition requirements apply.

Section 8 — Intellectual Property

All artwork, designs, images, text, and other content on the Store are owned by Aleksei Avduevskii trading as HMBInk, or used under licence, and are protected by UK and international copyright and intellectual property law.

You may not reproduce, distribute, modify, or use any content from the Store for commercial purposes without our prior written consent. All rights not expressly granted are reserved.

Section 9 — Third-Party Links and Tools

The Store may contain links to third-party websites. We are not responsible for their content, accuracy, or practices. Accessing third-party sites is at your own risk.

We may provide access to optional third-party tools. These are provided "as is" without warranty, and we accept no liability for their use.

Section 10 — Privacy

Your personal information is collected and used in accordance with our Privacy Policy, available at hmb.ink/policies/privacy-policy. By using the Store, you acknowledge our privacy practices.

As the Store is hosted on Shopify, your data is also subject to Shopify's Privacy Policy (shopify.com/legal/privacy).

Section 11 — Feedback and Reviews

If you submit feedback, reviews, or suggestions to us, you grant us a perpetual, royalty-free, worldwide licence to use, reproduce, and publish that content for any purpose, including improving and promoting the Store.

You confirm that you own or have the right to submit any content you provide, and that it does not infringe any third party's rights.

Section 12 — Prohibited Uses

You may use the Store only for lawful purposes. You must not:

• Use the Store for any unlawful, fraudulent, or harmful purpose

• Infringe our or any third party's intellectual property rights

• Transmit spam, viruses, or malicious code

• Scrape, copy, or extract Store content without our consent

• Impersonate any person or entity

• Use automated tools, bots, or AI agents to access or interact with the Store without our explicit permission

Section 13 — Automated Agents

No automated software, bot, or AI agent may access or interact with the Store unless it clearly identifies itself in all HTTP requests (including in the user-agent string) and operates in compliance with our robots.txt. We reserve the right to block or limit access by any agent.

Section 14 — Disclaimer of Warranties

The Store and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Store will be uninterrupted, error-free, or secure.

Section 15 — Limitation of Liability

To the fullest extent permitted by applicable law, Aleksei Avduevskii trading as HMBInk shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Store or products purchased through it.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

Section 16 — Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation.

Section 17 — Indemnification

You agree to indemnify and hold harmless Aleksei Avduevskii trading as HMBInk from any claims, losses, or damages (including legal costs) arising from your breach of these Terms or your unlawful use of the Store.

Section 18 — Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. For material changes, we will notify you by email or by a prominent notice on the Store. Your continued use of the Store after such changes constitutes acceptance of the updated Terms.

Section 19 — Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Store shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Section 20 — General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision does not constitute a waiver of that right.

These Terms constitute the entire agreement between you and us regarding your use of the Store.
